Firms looking for a new domain name must avoid trademark infringement, expert warns
Companies looking to register a domain name as they look to venture online must ensure that they do not infringe on somebody else's trademark.
Kevin Calder, a partner at Mills & Reeve LLP, told businessweekly.com that companies must make sure the domain name they have is not being used by other entities.
He warned that if businesses do infringe on trade marks, they could face a claim for damages or an injunction that could stop the company using the domain name.
Mr Calder added that it can be easy to forget that buying a domain name could cause difficulties in regards to trademarks, but that it is best to check.
"It's easy to forget that using a domain name could infringe someone else's trade mark, even if you had no intention of taking unfair advantage of that trade mark," he told the news provider.
Domain name registration can be an "amazing opportunity" for companies looking to increase their presence online.
